Senator Flávio Bolsonaro's defense filed three petitions at Brazil's Supremo Tribunal Federal (STF), the Supreme Court, on Friday 30 October 2026, asking that Justice Alexandre de Moraes leave a betting-linked money-laundering inquiry and that the precautionary measures against the senator be reviewed.

Flávio Bolsonaro (PL-RJ) is not Jair Bolsonaro; the filings concern the senator. He and a businessman are under investigation, and both deny wrongdoing. The allegations remain unproven and both are presumed innocent.

What the three petitions ask

The filings split the challenge between two audiences. Two petitions went to STF president Edson Fachin and contest Moraes remaining as rapporteur, according to Brasil 247 and Diário do Nordeste. The third went to Moraes himself and asks him to review the restrictive measures.

According to Gazeta do Povo, the defense wants the inquiry sent to Justice André Mendonça. The Federal Police, Brazil's federal investigative agency, drive the underlying probe, which examines whether the senator and the businessman held an indirect partnership to launder money, including through a company in the betting sector.

The aircraft argument

The central argument for removal concerns a business jet. The defense says Moraes and his wife used a Legacy 650 aircraft, registration PP-NLR, in July and August 2025. It says the jet belongs to Fraction 024 Administração de Bem Próprio S.A., a company that appears in the investigation, according to Gazeta do Povo.

The petition also alleges that shares in Fraction 024 were destined for the law firm of Moraes's wife, and that Banco Master hired her for R$130 million. Gazeta do Povo reports that the firm denies the commercial link. Brasil 247 reports that the petition does not claim Moraes acted out of private interest.

Why Mendonça

The defense argues that Mendonça is the natural alternative because of cases he already oversees:

  • Operação Sem Desconto, the probe into fraud in discounts on pensions paid by the INSS (Brazil's social security institute), under Mendonça since August 2025.
  • Petição nº 16.435/DF, under Mendonça since 17 July 2026, which covers the same business structure. The petition quotes the Federal Police describing it as a financial, asset and logistics hub for money laundering, according to Brasil 247.

The measures under challenge

Moraes imposed the measures on the night of the 25 October runoff, without a prior opinion from the Procuradoria-Geral da República (PGR), the federal prosecutor's office. As covered in our report on the runoff held with betting banned, the vote was already clouded by scrutiny of wagers linked to the senator's circle. The measures are:

  1. Cancellation of the senator's Brazilian passports.
  2. Surrender of his Italian passport.
  3. A ban on contact with the businessman.

Gazeta do Povo reports that the order rested partly on statements by Eduardo Bolsonaro. The defense counters that a bank denied the senator was a "usuário master" of the accounts of a company linked to the businessman. It argues that flight risk cannot rest on third-party statements, and that contesting an election result through institutional channels is no evidence of intent to flee.

On the substance, the defense describes the evidence as friendship: the senator was the businessman's favorite contact in a messaging app, and the businessman paid for his airfares, according to Brasil 247.

Where the case stands

The senator left Brazil on 27 October with his wife and daughters, according to Diário do Nordeste; our coverage of his arrival in Miami after the passport order details that sequence. As of 2 November, the STF had not ruled on the impediment, redistribution or revocation requests, according to O Tempo and Piranot. Piranot adds that the restrictions stay in force if Moraes remains rapporteur.

The probe adds to a run of Brazilian scrutiny of the betting sector, which began with the 2024 inquiry into sports betting and match-fixing and the Senate's parliamentary inquiry commission. For operators, affiliates and payment processors, the practical exposure is any commercial link to companies named in the inquiry. A change of rapporteur could alter how aggressively the betting-sector angle is pursued.

The next step is a decision from Fachin on whether Moraes is impeded or suspect, and a separate ruling from Moraes on the precautionary measures.

Status reviewed on 3 November 2026. Filing details and dates come from Brazilian press reports of the petitions. More regulation news and Latam-Caribbean coverage.

Frequently asked questions

What did Flávio Bolsonaro's defense ask the Supreme Court to do?

The defense filed three petitions on 30 October 2026. Two ask STF president Edson Fachin to remove Justice Alexandre de Moraes as rapporteur of the betting-linked money-laundering inquiry. The third asks Moraes to review the precautionary measures against the senator, including the passport restrictions and a contact ban.

Why does the defense want André Mendonça to take over the case?

The defense says Mendonça has overseen Operação Sem Desconto, the INSS pension-discount fraud probe, since August 2025. It adds that he has handled Petição nº 16.435/DF since 17 July 2026, which covers the same business structure the Federal Police describe in the Bolsonaro inquiry.

Which measures against Flávio Bolsonaro are being contested?

The petitions contest the cancellation of his Brazilian passports, the order to surrender his Italian passport, and a ban on contact with a businessman who is also a subject of the inquiry. Moraes imposed them on the night of the 25 October 2026 runoff, without a prior opinion from the PGR.

Has the STF decided on the requests?

No. As of 2 November 2026 the Supreme Court had not ruled on the impediment, redistribution or revocation requests. According to Piranot, the restrictions imposed by Moraes remain in force for as long as he stays on as rapporteur of the inquiry.

What does the inquiry examine?

The inquiry examines whether Flávio Bolsonaro and a businessman held an indirect partnership for money laundering, including through a company in the betting sector. Both deny wrongdoing. The allegations are unproven, and the senator is presumed innocent.
