Flávio Bolsonaro Reaches Miami After Defying a Supreme Court Passport Order in a Betting-Linked Probe
Flávio Bolsonaro landed in Miami on 28 October 2026 after leaving Brazil via Argentina despite an STF order to hand over his passports in a laundering inquiry.

Brazilian Senator Flávio Bolsonaro landed in Miami on 28 October 2026, a day after crossing into Argentina in breach of a Supreme Court order that barred him from leaving Brazil while he is investigated for suspected money laundering, including alleged hidden stakes in a betting company. The private flight touched down at Miami-Opa Locka Executive Airport at about 10:25 local time, CNN Brasil reported.
Flávio, the son of former president Jair Bolsonaro, lost the presidential runoff to Luiz Inácio Lula da Silva on 25 October. He has not been charged with any crime and denies wrongdoing. What follows sets out what courts, police and officials have confirmed, and what rests on press reports.
The departure, step by step
The timeline below draws on statements from Argentina's National Migration Directorate, US Customs and Border Protection records and reporting by CNN Brasil, Exame and the Associated Press.
| Date (2026) | Event | Basis |
|---|---|---|
| 25 October | Lula wins the runoff; Justice Alexandre de Moraes orders Flávio's passports seized and bars him from leaving Brazil | CNN Brasil, AP |
| 26 October | Federal Police serve the order; 24 hours to hand over all passports, including any foreign ones; no contact with a lawyer friend also under investigation | Exame, CNN Brasil |
| 27 October, 11:00 | Deadline expires without the passports being surrendered | CNN Brasil |
| 27 October, noon | Federal Police cancel his ordinary and diplomatic passports | CNN Brasil |
| 27 October, about 22:50 | Crosses the Tancredo Neves bridge from Foz do Iguaçu to Puerto Iguazú with his family | Argentine migration agency |
| 27 October, about 23:30 | Private jet leaves for Guayaquil, Ecuador | CNN Brasil |
| 28 October, morning | Refuels in Guayaquil and continues to Florida; lands in Miami | CNN Brasil, AP |
Argentina's migration agency said the four travelers presented valid documents and faced no legal impediment. According to a police source quoted by CNN Brasil and a Brazilian diplomat quoted by AP, Flávio entered Argentina on an Italian passport, which a Brazilian court cannot cancel. CNN Brasil and Metrópoles report that US border records list his Brazilian diplomatic passport, the one cancelled the day before. Two US officials told CNN Brasil that visas were being issued to the family. Argentina's government first denied he had entered the country before its migration agency confirmed the crossing.
What the inquiries allege
The Supreme Federal Court (STF), Brazil's highest court, handles the case because sitting senators are tried there. CNN Brasil counts three inquiries naming Flávio: one for alleged slander against Lula, one into the financing of Dark Horse, a film about his father, and one into suspected money laundering and evasion of foreign currency with a lawyer who is a friend of his. The betting allegations sit in the third.
According to CNN Brasil and Exame, the Federal Police suspect that:
- Flávio had hidden economic and corporate stakes alongside the lawyer, including in a holding company, Alcazar Holding, on whose bank account he allegedly appears as a "master" user;
- an account connected to the arrangement recorded about R$130 million in transactions between March and May 2025, which investigators see as out of line with Flávio's known activities;
- he was a partner in a betting company the lawyer founded, and there may have been irregularities, including suspected bid rigging, around a Rio de Janeiro lottery license.
The inquiry began as a Federal Police procedure in Rio Grande do Sul, Exame reported. No Federal Police operation name has been publicly attached to the part involving Flávio. On 23 October Moraes separately froze up to R$6 billion in assets linked to the lawyer; Exame stresses that this is a ceiling, not an amount seized. The lawyer's legal team calls the measures disproportionate and denies any business partnership with the senator.
Background on the case, including a Finance Ministry note on the lawyer's betting volumes, is in our earlier report on how Brazil went to the runoff with betting banned and a Bolsonaro friend's wagers under scrutiny. Betting licenses issued by Rio's state lottery have been contested before, as when Loterj sued to halt the federal SPA list.
What Flávio and Lula have said
Before leaving, Flávio posted a video saying he had been served and barred from leaving the country. He called the order "uma clara tentativa de me intimidar" (a clear attempt to intimidate me) and persecution, said it was based on a remark by his brother Eduardo, and said he would hand over his documents. He also said he had never intended to leave. He has made no public statement since arriving in the US; a source close to him told CNN Brasil he feared arrest. Reports that he will seek asylum are unconfirmed.
Lula, speaking on 27 October, called the departure "vergonhoso" (shameful) and said someone who leaves in secret "deve alguma coisa" (owes something), SBT News reported.
Is he a suspect?
Yes, in the sense that he is named in STF inquiries and is subject to court-ordered restrictions, according to CNN Brasil and Exame. Before the runoff his campaign said he was not under investigation. No indictment has been filed, and he is presumed innocent. AP reports that the court considered him a flight risk.
What happens next for the case and for betting
The inquiries do not end with his departure. CNN Brasil says the STF decided by majority in 2025 that lawmakers who leave office still answer to the court, so the cases should stay there after his term ends in February 2027. No arrest warrant or extradition request has been reported.
For the industry, the case lands while Brazil's licensed market is shut under Provisional Measure 1,394, and after a year of disputes over who may license betting, set out in our look at Brazil's online gambling market facing its biggest legal test. The Finance Ministry's Secretariat of Prizes and Bets produced the note on the lawyer's betting volumes, and the Federal Police have long warned about gambling and money laundering. An investigation, however, is not a finding.
Status reviewed on 29 October 2026. Court orders and travel details are as reported by CNN Brasil, Exame and AP; allegations are the Federal Police's and unproven. More legal news and Latin America coverage.
Frequently asked questions
Why did Flávio Bolsonaro go to Miami?
He has not explained it publicly. He left Brazil on 27 October 2026, a day after being served with a Supreme Court order to surrender his passports, and landed in Miami on 28 October. A source close to him told CNN Brasil he feared being arrested. Reports that he will seek asylum in the US have not been confirmed by him or by US officials.
What is Flávio Bolsonaro accused of in the betting case?
Federal Police investigators suspect he held hidden economic and corporate stakes with a lawyer friend, including in a betting company and a holding company with a bank account on which he allegedly had master access. They are investigating suspected money laundering and illegal currency transfers. These are allegations under investigation; he has not been charged and denies wrongdoing.
Is Flávio Bolsonaro formally under investigation?
Yes, according to CNN Brasil and Exame, which report that he is named in Supreme Court inquiries and is subject to court-ordered restrictions. Before the runoff his campaign said he was not under investigation. No charges have been filed, and he is presumed innocent until a court rules otherwise.
Can Brazil's Supreme Court still hear the case after his Senate term ends?
Probably. Senators are tried by the STF under Brazil's special jurisdiction rules. According to CNN Brasil, the court decided by majority in 2025 that lawmakers who leave office still answer to it for crimes under investigation. Flávio's Senate term ends in February 2027, so the inquiries are likely to stay at the STF.
How did Flávio Bolsonaro leave Brazil if his passports were cancelled?
According to sources cited by CNN Brasil and AP, he entered Argentina using an Italian passport, which a Brazilian court order cannot cancel. CNN Brasil and Metrópoles report that US border records show he then entered the US on his Brazilian diplomatic passport, which the Federal Police had cancelled the day before.
