Brazil’s regulated betting market is witnessing growing pains as the country enforces stricter compliance protocols. The Secretariat of Prizes and Betting (SPA), under Brazil’s Ministry of Finance, has ramped up oversight on temporary licenses granted to iGaming operators. Among the first high-profile cases was the suspension of Pixbet Soluções Tecnológicas — one of Brazil’s most prominent sports betting operators.

However, a significant court ruling has now turned the tide in Pixbet’s favor.

On April 11, the SPA suspended temporary licenses for four major operators: Pixbet, Caixa Loterias, TQJ–Par (Grupo Silvio Santos), and 7MBR LTDA (Cbet). The basis was failure to submit technical certifications required under Ordinance No. 300. This regulation, issued in February 2024, mandates that all operators prove system readiness through certified documentation, covering betting systems, remote game servers (RGS), and integration processes.

Pixbet immediately challenged the suspension through a legal maneuver known as a writ of mandamus. It argued that all required documents were submitted, though one — the integration certificate — arrived a day after the deadline. The Federal Court accepted this explanation.

The court ruled that the delay was minor and non-malicious. It emphasized that SPA’s regulation aimed to ensure operational security, not punish minor administrative oversights. The judge pointed out that all technical requirements were eventually met. Penalizing Pixbet under such circumstances, the court concluded, would be excessive and economically damaging.

Of particular note was the court’s reference to Pixbet’s active sponsorship agreement with Flamengo, one of Brazil’s most popular football clubs. Suspending the operator could have had ripple effects throughout the sports and advertising sectors.

While Pixbet’s license is now reinstated, the other three operators remain under suspension. These companies must either submit their missing documentation within the SPA’s grace period or face permanent license revocation. Under Ordinance No. 300, operators were given until December 30, 2024, to comply, with a possible 30-day extension under valid justification from a certified testing body.

During suspension, affected platforms are not allowed to operate or accept new bets. However, users can still access their accounts to withdraw balances. If the deadline passes without complete certification, no further extensions will be granted, and licenses will be revoked permanently.

Pixbet, which also operates brands like Flabet and Bet da Sorte, is now back in the game. But this incident serves as a clear warning to other operators navigating Brazil’s transitional betting framework.

This ruling also sets a precedent. The court’s willingness to prioritize intent and effort over rigid timelines suggests a more balanced approach to regulatory enforcement. While SPA will continue its crackdown, operators acting in good faith may find some flexibility — especially when the stakes include major financial and sports sponsorships.

For now, Pixbet’s win signals a cautious optimism for the industry. But for the others, the countdown to compliance continues.
