Despite assurances from Encore Boston Harbor attributing the initial incident to a temporary glitch with platform provider GAN, subsequent infractions persisted, prompting regulatory intervention.
During the adjudicatory hearing, Encore Boston Harbor acknowledged the unauthorised wagers on Massachusetts women’s basketball teams and a Boston College women’s basketball game. The sportsbook attributed these lapses to logistical challenges, citing last-minute uploads to the system shortly before the commencement of the respective games. However, such actions contravene Massachusetts General Law Chapter 23N Section 3, MGC regulation 205 CMR 247.01(2)(a)(2), and the Massachusetts Sports Wagering Catalog.
Given the recurrence of violations and the operator’s failure to demonstrate adequate control over its vendors, the Massachusetts Gaming Commission deemed it necessary to impose a $40,000 fine as a deterrent measure.
