The Arkansas Racing Commission is set to deliberate on these proposed rule changes on January 30. These revisions are crucial in establishing a clear and straightforward application period for the coveted Pope County casino license.

Approval and Implementation Timeline

Following publicization, the new rules require the approval of the Arkansas Legislative Council. Afterward, a ten-day window is allocated for filing with the Secretary of State, marking the rules’ official enactment. Deputy Attorney General Doralee Chandler anticipates a timeline of 60 to 120 days for the rule promulgation.

Resolving Ongoing Disputes in Pope County

The Pope County casino license has been a contentious issue, stirring multiple court cases and public debate. These proposed changes come in the wake of the Arkansas Supreme Court’s rejection of petitions from Legends Resort and Casino and Cherokee Nation Businesses, which challenged the court’s decision against the commission’s initial awarding of the license.

Amendment 100 to the Arkansas Constitution, approved by voters in 2018, authorized the Arkansas Racing Commission to license four full-fledged casinos. Currently, three operate in Hot Springs, Pine Bluff, and West Memphis, with Pope County’s license still under consideration.

Chandler emphasizes the need for a new, open application period, devoid of legal ambiguities. She advocates for removing the clause “except for good cause shown” from the rules, aiming to establish a definitive 30-day application window that discourages potential litigation.
