The Winning Poker Network and Goldwin Ltd have been subjected to penalties by the KSA

Two operators have been penalized by the Dutch regulator de Kansspelautoriteit (KSA) for unlawfully enabling Dutch players to access their services.

Following their operation without a Dutch license, both Winning Poker Network and Goldwin Ltd were cautioned by the KSA. While Goldwin Ltd ceased operations in response to the warning, Winning Poker Network did not take such action.

Consequently, Winning Poker Network has been directed to make weekly payments of €25,000, with a maximum total of €75,000. Goldwin Ltd, on the other hand, received a penalty of €239,000, with a potential maximum penalty of €717,000. If Goldwin Ltd were to offer its games to Dutch players again in the future, they would be required to pay the penalty once more.

Both rulings issued by the KSA are subject to appeal

“The providers of games of chance must see the value in offering their games legally,” stated René Jansen, Chairman of the KSA. “This can only be achieved by curbing illegal activities. We are fully committed to putting an end to these practices.”

During the investigation, Winning Poker Network was found to operate Americascardroom.eu. The KSA noted that no measures were in place to prevent Dutch customers from accessing the website. Additionally, Winning Poker Network was identified as the operator of Truepoker.eu.

Throughout the investigation, it was discovered that the login credentials created for Truepoker.eu did not grant access to Americascardroom.eu, necessitating the creation of a separate account to continue with the inquiry.

On 28 November 2022, the KSA informed Winning Poker Network of its intent to impose a penalty. The operator responded on 12 December, confirming that Dutch customers would no longer be able to access Americascardroom.eu.

In the case of Goldwin, the KSA found that the website Westcasino.com was operated by the company, despite Goldwin not having a valid gambling license in the Netherlands.

Between 1 March 2022 and 1 February 2023, the site received 907,246 visits from the Netherlands.

When notified of the intended penalty by the KSA, Goldwin did not provide any response.
